Abstract (EN)
In article 179 of execution and bankruptcy law which revised by the Law numbered 4949, direct bankruptcy of corporations and cooperatives is regulated. In the same article, in some conditions, in order to protect interests of debtor, creditor and public, postponement of bankruptcy has been regulated. Postponement of bankruptcy had been regulated in article 324/II of Turkish Trade Law but it was not applicable since it was not detailed enough. Measures to be taken by the judge and results of postponement of bankruptcy has been regulated in article 179/a and 179/b of Execution and Bankuptcy Law reregulated with the Law numbered 4949. Those regulations form the main subject of our thesis. The widespread implmentation of postponement of bankruptcy has also increased the importance of these issues. Besides the legal regulations on this subject, there are many doctrinal controversies. In our study, legal regulations and doktrinal discussions on the measures taken on the postponement request and results of postponement decision have been evaluated in detail.
