Crime of rigging in tenders

The crime of rigging in tenders settled in article 235 of Turkish Penal Code no.5237. This article is in Second Book named "Special Provisions" in Third Part "Offences Against the Public" in Ninth Part named "Offences Against the Economy, Industry and Trade". The first and fifth paragraphs include which tenders and institutions are in the scope of this crime, the first paragraph is about the basic penalty, the second paragraph includes what the acts of rigging are, the third paragraph includes qualified versions of this crime, the fourth paragraph includes the situations that aggregation provisions will be applied. The law number 6459 of 11 April 2013's twelfth article has made some changes of article 235 of Turkish Penal Code. İn this study the general information about tender and the crime of rigging in tenders is given and the elements of crime, the special forms of crime, the punishment, the procedure examined.
