Imam Gazzali's procedure opinions in the financial treatment section of Tahsinu'l-Maahiz book (A practical study)

As it is known, istinbat is essential in matters in fiqh. Imam Gazzali, in his book Tahsînü'l-Maâhiz, dealt with many usûl views in many types and fields of fiqh. This treatment of him means the application of these views and the explanation of the method of inference. This situation shows the importance of this issue. It was decided that the subject of study, especially that Imam Ghazali is one of the reputable imams in the field of fiqh methodology, should be in the form of explaining the method of inference by bringing together these procedural views. The study area is limited only to the transaction section of the mentioned book and the unstudied title; It has been selected as "The Methodical Views of Imam Ghazali in the Financial Transactions Chapter of Tahsînü'l-Maâhiz Book". The study consists of introduction, five main chapters and their sub-titles and conclusion. In the first chapter, the concepts of fiqh and usûl are explained, Imam Ghazali and his book Tahsînü'l-Maâhiz are introduced. In the remaining chapters, the method views and practices of Gazzali, which are included in the Transactions Section of Tahsin al-Maahiz Book and the number of which reached twenty, are mentioned. These are discussed under the following headings: 1- Procedural views on the evidence in agreement, 2- Procedural views on the disputed evidence, 3- Procedural views on linguistic procedural rules, 4- Procedural views on argument and preference. Each of these sub-headings is discussed in four sections: a) The meaning of the issue, b) The fiqh issue in the book Tahsînü'l-Maâhiz c) Ghazali's text on the procedural issue in question, d) Discussion and inference. The study was completed with the conclusion and recommendations section, which includes the most important results reached by the researcher.
