Abstract (EN)
Reconstruction plans, the most important application instrument of reconstruction law, have essential principles such as public interest, urbanism principles, planning essences and form their editing fields in the light of these principles. Presence of hierarchy that contains meaning of implementation priority in reconstructions plans starting from these principles of view, comes at the beginning of issues attributed to the special importance. Here, our study?s research subject appears as questioning existence of the hierarchy between reconstruction plans.When questioning;1)Are well definition and classification of reconstruction plans done in legal statue, in fact among the plans is there a hierarchy?2)Why an upside-down association is needed among the plans and in practice what are the outcomes of the hierarchy, what kind of disadvantages are come out when prepared plans do not match with the hierarchy principles?the questions are tried to be answered.When it is trying to answer the questions, due to complexity of many titles in legal statue and legislation inflations and it was mentioned not having a defined concrete plan description, it is emphasized not producing plan pattern both on the basis of scale and quality.Consequently; within any organization/governance in order to work adaptably an existed hierarchy is required, which regulating settlements of millions of people and affecting their lives directly, it is agreed to have vital importance of existence in terms of providing the stability and determining the application harmony to the standard of living among the reconstruction plans, in our country immediately with all patterns from the lowest scale to highest scale all reconstruction plans? definition and classification are performed, the authority preparation is summed up in one hand, the subject of requirement of a large scaled legislation is emphasized
