Abstract (EN)
It is clear that international trade is an indispensable value for the countries of the world. Correct communication between stakeholders in international trade is a key point and also it is important point to avoid potential problems. In this context, the importance of the term uniformity not be ignored for the world which is connected to each other with the developing and advancing technological developments. Based on these concepts, Incoterms® delivery methods have been published by the International Chamber of Commerce (ICC) for the purposes of sustainability, facilitation, more fair and free trade, standardization, elimination of uncertainties arising from different interpretations and practices in different countries. These rules regulate the concepts of risk, cost and responsibility for the buyer and seller, which are the basic elements of international trade. Incoterms® delivery methods have undergone revisions over the years according to the needs arising from the developing and growing world markets, some terms have been completely removed and some terms have been updated in line with the needs. First issued in 1923, then published as Incoterms in 1936 and 1953, 1967, 1976, 1980, 1990, 2000, 2010, and the ninth also the last version, Incoterms® 2020, was published on 10 September 2019.Incoterms® has been a set of rules that are commonly accepted and used by all stakeholders (governments, legal authorities, buyers and sellers ...) in the world trade. Considering all these reasons, Incoterms 2020 delivery forms are a good research and examination subject for our thesis. In the thesis, the comparative method was used in order to compare the Incoterms 2020 with the previous versions and to present the changes more clearly. It will be interpreted within the framework of the published Incoterms® 2020 and the recommendations in the conclusion. What makes our study unique from another review thesis will be the interpretation of the Supreme Court decisions within the framework of the newly published Incoterms® 2020 and the suggestions presented in the conclusion. The main purpose of our thesis; With the new version, what interpretation differences it aims to prevent and how it helps users; which points it clarifies more than the old versions, which interpretation differences it aims to prevent and how it helps users. The problems experienced in business life and Incoterms® 2020 presented in the last section The examination and interpretation of the Supreme Court decisions and the suggestions presented in the last section are the points that make the thesis original.
