European Convention on Human Rights and its effect on Albanian judicial system

Abstract (EN)

As a post-communist country, respecting and protecting human rights is considered to be one of the most important challenges for Albania. At the same time, as an EU candidate country, making progress in this regard is one of the main priorities for the country. In this context, the European Convention on Human Rights (ECHR) has become a part of the Albanian legal system. It can be said that the ECHR has a privileged status in the legal system of Albania, among the international legal instruments, both in keeping up with the modern world and as part of the EU harmonization process. In this master's thesis, the impact of the European Convention on Human Rights on the Albanian legal system has been analyzed. In addition, the outcomes of the Convention in terms of domestic law and its practice in Albania are analyzed. The implementation of the ECtHR decisions are also included within the scope of the study. Finally, recommendations are made based on the decisions taken by the European Court of Human Rights regarding Albania.
