Abstract (EN)
A group numerically inferior to the rest of the population of a state, in a nondominant position, whose members-being nationals of the state, posses ethnic, religious, or linguistic characteristics differing from those of the rest of the population and show, if only implicitly, a sense of solidarity, directed towards presserving their culture, traditions, religion or language may be termed as minorities.The issue of minorities which has always been a crucial problem in the context of international relations. In this study titled ?MİNORİTY RİGHTS İN THE CONTEXT OF PROTECTİON OF HUMAN RİGHTS?, the minority rights were considered in a normative way and the categorizations were made examining the concept of minority then a general historical progress of the minority rights were examined. International documents concerned with the subject within frame of the League of Nations and the United Nations and progresses have regional characteristics occurred in Europe, conventions on human rights and rights specified on the Language Rights of Minorities and the Framework Convention were discussed within the scope of minority rights.The issue of minorities, one of the main concerns of the European Union especially after 1990?s when Union aggreed to be a political union besides an economic one. Despite the fact that the majority of international organisations is in the aim to identify the minority problem and define a generally accepted solution in the supra-national level , there is neither a clear-cut definiton of the term of the ?minority?, nor an internationally standardised legal basis has been determined yet.The fundamental act regarding the protection of minorities in Turkey is provided and referred in the Lausanne Treaty, particularly at the 1st Section titled as ? Political Terms? and .in .1st Section .titled .? Protection .of .Minorities? and .3rd part .(articles no. 37-45). It appears that the minorities are legally described as only the non Muslims.
