Crime of human trafficking

This thesis aims to investigate human trafficking offence which deeply affects human dignity and self-respect in terms of penal law through its historical development.Human trafficking, which merchandises human being and a kind of exploitation, is an uncivilized action. Human trafficking is closely related to slavery in which a person deprived from its basic rights as a human being. While slavery was an accepted phenomenon for many societies and religious in several parts of the world in the past century, it is not seen except for some cases as a result of international efforts. However, disappearance of slavery does necessary not to mean that merchandising human being is also vanished. Merchandising human being for several purposes is continued through human trafficking.Turkey is at an important crossroads in terms of human trafficking as it is an opening door to rich European states. In addition, Turkey is used as a main route to traffick human beings, particularly women trafficking, from former Soviet Union states to Europe. Therefore Turkey involves several international efforts to prevent human trafficking and also added 201/b article to the 765th act of TCK by 4771st act in 2002. Human trafficking is layout in the 80th act of YTCK.As it is the case for all studies focused on crimes, this study emphasizes the importance of physical and moral aspect of penalty, protected jurally benefit special appearance of crime such as attempt, participation, and concurrence and the discussions raised in these issues, and finally suggested penal sanctions and prosecutions for crime.
