Domain name disputes and possible solutions: A comparison analysis

Abstract (EN)

The rapid developments in the internet lead to disputes about domain names, which act as an indicator. The current legal rules remain insufficient in solution to different domain name disputes. There are two widely used solution mechanisms to resolve these disputes, which include bringing an action and domain name dispute resolution policy. This paper examines legal rules for domain names in both Turkish and American law in the context of private law. Furthermore, it addresses the widely used resolution mechanism for these disputes. As a result, the current paper presents useful information about the mechanism to people facing the domain name disputes who has rights on the relevant domain name.
