Abstract (EN)
The subject of this study is to set forth the distance-contract liabilities before consumers of intermediaries who are dealing business through Internet. Contracts established by consumers through intermediaries via Internet are, as a principle, distance-contracts. In such distance-contracts the liabilities of the seller/service provider as well as the responsibilities before consumers are clearly set forth in the legislation. Accordingly, consumers achieve strict protection against seller/service provider. The sole arrangement focusing on the legal affair between intermediaries and consumers, however, is clause 48/5 of the Law on the Protection of the Consumers. As such clause is quite ambiguous, the scope of the liabilities before consumers of platforms, which deal business through Internet and which act as intermediary for establishment of a distance-contract, is questionable. In this study, we aim to survey the position of intermediaries within the system and to identify liabilities and related conditions thereof by taking into consideration different opinions about the matter.
