Right to access internet

This study deals with Right to Access Internet. Internet access, with its political, economic, social and cultural uses, has a very important place for modern life. States aim to ensure the universality, integrity and openness of the internet. In the study, general international law and international human rights law and judicial decisions taken in Turkey were examined for the existence and scope of the right to access internet. The right to access the internet is known today as an element of many pre-existing fundamental rights and freedoms, especially freedom of expression. In this context, the connection of the right to access the internet with other rights and the importance of access to the internet are discussed. Today, the internet has separated from its feature of being an information media and has taken the new form of a media that has settled in the center of social life. A delicate balance needs to be struck between the freedoms that people have and the interventions being made in these freedoms, and it is very important to observe the principle of proportionality while establishing this balance. The situation of blocking access to the internet is known as a dangerous balance tool that needs to be applied in an environment such as the internet, where interference with freedoms is seen effectively. Within the scope of the study, the right to access the internet has been evaluated, and the place of the right to access the internet has been explained in the light of the decisions of the Constitutional Court and the European Court of Human Rights.
