Özet (EN)

My thesis study deals with the structure of constitution in Iraq and its adoption procedure. The abstract of my thesis study has comprised four parts. First Part deals with the General Principles. Second Part deals with the Development of Constitution in Iraq. Third Part deals with the Iraqi State Administration Act for the Transition Period of 2004. Finally, Fourth Part deals with the Permanent Constitution enacted in Iraq in the year 2005.The topics that I refer in the First Part are generally dealing with the manner how to make a constitution, and also the procedures of adoption and concept of Constitution in general and detail. Second Part explains in detail the development process of Constitution in Iraq and points out how many constitutions have been so far drafted in Iraq and how they had been drafted (covering the years 1925 ? 1958 ? 1963 ? 1964 ? 1968 ? 1970) It furthermore dwells on the Occupation of Iraq in 2003. In the Fourth Part I especially dwelt on the law regarding the Transition Period of 2004 and explained in detail how this constitution had been drafted and voted. In the Fourth Part, I dwelt on the Parliamentary Elections held in the year 2005 and set forth my views dealing with the Permanent Constitution adopted in Iraq in the year 2005 and explained in detail how this constitution had been drafted and how the Constitutional Committee had been established and how this constitutional text had been presented to the referendum and what was the adoption procedure to be followed. Finally, in the abstract of my study, I scientifically put forward how this constitution had been enacted and took effect in Iraq.When we also take into consideration the importance of this thesis and the reason for selecting this topic, it appears that my other colleagues, as a thesis subject of master degree education, have also preferred to dwell on the Executive, judicial and Legislative Powers granted by the Iraqi Constitution. My thesis study subject which dealt with the structure of constitution in Iraq and its Adoption Procedure, has never been take up as a monographic study subject either in Turkey or Iraq. This serves to indicate the importance of my thesis subject and the reason why I have preferred it
