Abstract (EN)

Throughout the history of the world, one of the attitudes that individuals have been subjected to, and perhaps the most important one, has been discrimination. Discrimination is the prejudice treatment of a person or group due to some of their characteristics. This behavior can be positive or negative. However, discrimination is generally a concept that has a negative tune. Discriminatory thoughts and practices are present in the background of all threats and violations against fundamental human rights. Discrimination in matters such as religion, language, race and gender causes violations of human rights. God defines man as a being that he breathed from His own soul. Regardless of individual's race, language, color and gender, God gave human beings great values, deemed worthy in the Quran. Everyone who believes or does not believe is equal before the law. In this study, based on the equality in question, it will be tried to mention the discrimination against women in Iran's legal system. Feminist movements that started after the White Revolution were shaped by women's movements in Iran. Since the Pahlavi period, modernization movements have been seriously involved in state policy. In this period, importance was given to political, social and legal reforms as well as Westernization and modernization activities in Iran, and women's movements emerged as an organized movement of this period. The Pahlavi Dynasty made significant contributions to the Iranian legal system and women's rights movement. During the Pahlavi Dynasty, the secondary position of women in society was tried to be elevated and as a result women were given some rights and freedoms. During this period, women gained rights in the fields such as the right to education, family law and also in political and social fields. In the Iranian Islamic Revolution of 1979, Iranian women played many important roles probably as much as men. For example, Iranian women, who played a very active role in the 1979 Revolution, took to the streets supporting the Revolution y Leader Ayatollah Khomeini to regain Islamic rituals and practices such as hijab and veiling that were denied in Shah's rule. However, the efforts of women who took to the streets to obtain their rights and freedoms left their place to the repression system in a very short time. Iranian style Islamic law after the 'Islamic' Revolution, the government tampered the legal system inserted its influence and the trace of 'sharia' has been made effective in all laws. Thus, Iranian law restricted women's rights in many places with the effect of Sharia and Islamic law, and in some cases caused the destruction of women's rights. For example: before the Iranian 'Islamic' Revolution of 1979, women's marriage age was 18, after the revolution reduced to thirteen. Such restrictions will be mentioned throughout the thesis.
