The sanctions of Labor Law

Fundamentally, Labor Law born from the requirement for prevention of workers. Owing to the weakness of a worker economically, labor regulations arised because of the idea that he has to be protected. At this point, Labor Law is like a basic source which orders the relationships within the working life. It is a basis that provides to apply in favor of both parties, worker and the employer which exist in the working life, as far as possible between the relationships of them. Labor Law comprises protective rules for workers especially to prevent the abuses directed to them. However, up to here although we mentioned about the regulations that aim to protect workers while we are talking about the regulations which are done for providing the work peace, in these regulations there are some sanctions that will be executed for workers too.Together with the regulations that our Labor Law brings to working life, it also tries to ensure the application of these regulations. The sanctions that will be imposed to ones which act against Labor Law are in judicial, penal, administrative and disciplinary types. In light of the foregoing, the sanctions are seperated into three parts such as; ?judicial sanctions? which are applied to workers and employers, ?administrative sanctions? which are applied to ones who act against the regulations in our 4857 numbered Labor Law with ?penal sanctions? which are applied to ones who act against the regulations in 2821 numbered Trade Union Law and 2822 numbered Collective Agreement Strike and Lockout Law, and lastly ?disciplinary sanctions?.Key Words: 1) Sanction 2) Labor Law 3) Judicial Sanction 4) Administrative Sanction 5) Penal Sanction 6) Disciplinary Sanction
