Abstract (EN)
Our study titled "The Effects of Flexible Working Models in Labor Law" consists of three sections. In the first section, the concept of flexibility and what flexible working entails are explained, followed by a discussion on the types of flexibility and the reasons leading to the emergence of flexibility. This section is concluded by describing the regulations related to flexible working in Turkish Law and International Law, as well as the consequences of flexible working for both employers and employees. In our study, we have categorized flexible working models into two: working hours and forms of employment. The second section focuses on flexible working models in terms of working hours. It begins with an explanation of what constitutes working hours and the situations that are considered or not considered as working hours, including overtime work and work beyond normal hours. Subsequently, the section discusses the models of flexibility in working hours, such as balancing (compensatory work) and the conditions, effects, and outcomes of these models. The section concludes with an explanation of staggered working hours and a detailed discussion of the definition, purpose, conditions, outcomes, and termination of short-time work. In the third and final section of our study, flexible working models in terms of forms of employment are examined. Initially, fixed-term employment contracts are analyzed, followed by an examination of the part-time working model. The subtypes of the part-time working model, such as secondary employment, job sharing, and on-call work, are then discussed in detail. The third section also provides a detailed explanation of the remote working model, which has become widely used in recent years, including its subtypes: home-based work and telework. Following this, temporary employment relationships where an employer temporarily assigns an existing employee to another employer with the employee's consent seasonal work contracts, and the increasingly popular platform work model due to technological advancements are explained, thereby concluding our thesis.
