Abstract (EN)

Aim: It was aimed to reveal the types of injuries occurring in work accidents through high judicial decisions in forensic medicine reports in this study. It was tried to provide information on the types and occurrence of wounds through the high judicial decisions examined. Material and Method: Special and official reports of forensic sciences dealing with the types of injuries in work accidents were examined and its effect on the trial was analysed. 33 high judicial decisions containing forensic reports regarding wounds were discussed. The types of injuries and the causes of injuries were examined in the high judicial decisions. Results: It was determined that the responsibility of the defect changed according to the type and manner of the wound causing the work accident, examining 33 cases that were subject to the Supreme Court of Appeals. Because if an incident is accepted as a work accident in terms of the Social Security Legislation, it is not necessarily the responsibility of the employer. In order to be able to be the responsibility of the employer, the employer must be faulty in the injury or damage caused by the accident. Conclusion: It is necessary to scientifically determine what type of wound occurred in the occupational accident, the reason for which it occurred and how the object causing "reckless injury and reckless homicideas" as defined in the Turkish Penal Code was formed. Therefore, the discovery of these is essential for good justice in the autopsy. Because the right determination of the type of wound and what kind of wound occurs as a result of the autopsy will be guiding that judicial units make the determination of the defect more healthy and the sanctions that will arise as a result of the work accident.
