Abstract (EN)

Businesses invest in with limited resources for health and safety and the practices they take are shaped by some legal, economic and human factors. While Human Resources Management protects the employee, which is the nature of occupational health and safety, takes care of the employee against stakeholders and follows the measures to be taken. For this reason, the study was conducted in a circle, especially employer, that takes account of stakeholders responsibilities related to occupational health and safety. The consequences of the employer in case of breach of the occupational health and safety obligations and the precautions to be taken and taken to avoid these consequences have been examined both by employer and state also worker dimension. In this context, the necessary institutional responsibility for the state, which is the duty of supervision to prevent this situation from occurring, has been revealed in addition to the legal legislation that must be brought against and deterring as a result of an accident or incident. In spite of all the measures, the rights of the employees in case of continuing danger and at the same time the responsibilities which are the most dangerous are examined. Within the European Union, the analyzes of member states in terms of employer, government and employee obligations are compared with each other. With the work done; the establishment of an essential positive safety culture for the legal order on occupational health and safety, emerging economic losses, unsuccessful occupational health and safety management as well as successful government incentives, occupational health and safety, and a source of legislation applicable by all stakeholders was targeted.
