Employee rights about the employer acting against obligation of occupational health and safety

This thesis is prepared for the aim of presenting the development of occupational health and safety terms in the world and our country and implementation methods of employee health and obligations of the employer from the social, economical, legal and moral aspects. The technology developing day by day and benefited by society is required to make provisions about occupational health and safety against various risks that generates in working life. It is clear that, making provisions regarding occupational health and safety will decrease correspondingly occupational accidents and professional diseases. Therefore, within the scope of employee surveillance liability, the employer obligations have been determined correctly and in case of breaching the obligations sanctions shall be stated in law transparently. Notwithstanding the law that lays burden on the employer about occupational health and safety, the employer shall be attentive and obey the rules set by the employer. Although, occupational health and safety has not come to the desired location today, it has gained a certain order by related legislation entered into force like Occupational Health and Safety Act No. 6331 and occupational health and safety by-laws. In this study, primarily an outline of occupational health and safety, occurrence and development of the occupational health and safety concepts and information about legislative process and legal status in our country are given, then obligations of the employer about occupational health and safety explicated, consequently the rights of the employee in case of breaching the obligations about occupational health and safety are explained.
