Abstract (EN)

On 20.06.2012, the Occupational Health and Safety Act no. 6331 was adopted. Accordingly, all employees are covered by the Law in question. The subject of our study is the obligations and rights of the employees in terms of occupational health and safety. Compliance with occupational health and safety obligations of employees and employers is essential to ensure a healthy and safe working environment. Therefore, the parties should first know these obligations and rights well. If the employees do not comply with the measures taken by the employer, various sanctions may be imposed. These are disciplinary action, compensation, termination of the employment contract. Employers should also supervise and protect their employees. Our study includes four chapters. In the first chapter, we covered the concepts of occupational health and safety, the purpose and resources of occupational health and occupational safety. In the second chapter, we consider the occupational health and safety obligations of the employers involved in the subject and we have found it appropriate to evaluate the effects of these obligations on the employees. Because we think that these obligations of employers cannot be considered as a separate issue because they constitute the compensation of employees' rights regarding occupational safety and health. We also examined the issue in terms of temporary employment relations, sub-employer workers and remote workers. In the third chapter, we first discussed the employees' obligations in terms of occupational safety and occupational health and then their rights in this regard. we assessed the responsibilities of the worker and the employer, the legal nature and the concept of defects. In the fourth chapter, which is the last chapter, we discussed the sanctions that can be imposed if the employees have not fulfilled these obligations. Since all employees are included in the scope of the Occupational Health and Safety Law no. Since Law No. 6331 applies to all employees, we have included the relevant provisions of the Law on Civil Servants regarding sanctions. In addition, when we talked about employees in our study, in some cases we used the term "worker" instead of "employee" as it was in the Turkish Debt Law.
