Abstract (EN)
Old age is one of the most important risks protected under social security law. In our study, first of all, the concept of old age and its reflections in international law were examined; then, old-age insurance and the benefits provided within the scope of old-age insurance were evaluated. In accordance with the scope of the study, these evaluations are restricted only to issues related to employees working with employment contracts. During the study, the works in the literature were used, judicial decisions including the decisions of the Supreme Court, the Constitutional Court and the European Court of Human Rights were examined, and statistical data were also used in order to determine the place and status of the elderly in the society. As a result of the study, the regulations regarding old age in international law could be seen as a whole, and the functioning of old-age insurance in the Turkish social security system and its problematic aspects were examined with references to practices in the foreign countries. In this context, especially the regulations on domestic service workers were evaluated in terms of gender-based discrimination; the status of platform workers and the disadvantageous position of part-time workers in old-age insurance was examined; the fact that the employees working in the underground mining workplaces are subject to rules on actual service term increase that would contradict the principle of equality is studied and many other problems were mentioned with relevant recommendations to solve the problems.
