Abstract (EN)

In this study, the judicial expertise, which is the most discussed evidence in terms of the limits and application of the civil procedure law, has been examined in terms of labour court proceedings. Despite being discussed a lot, the number of cases in which experts are consulted is constantly increasing due to the developments in science and technique. In the first part of the study, the concept of the judicial expertise and its foundations in labour court proceedings were examined. In the second part, the judicial expertise is discussed in terms of compensations, labor claims, technical issues in reemployment lawsuits, and fault which is the subject of judgment in lawsuits filed as a result of work accidents. At the same time, in terms of labour court proceedings, the time to apply for the judicial expertise is also mentioned. The distinction between legal issue and material issue, which leads to debate in all fields, is addressed in terms of labour court proceedings and the issue is discussed in terms of both doctrine and application of the Supreme Court.
