Abstract (EN)

The word secret corresponds to information that is known to certain people and is therefore found to be of legal benefit to the owner in keeping it secret, and therefore it is undesirable to be known by other people. There is undoubtedly a material necessity for the protection of the secret that has these characteristics. The importance of confidential information taking up more and more space in commercial life and increasing importance accordingly has also been reflected in labor law. Although the basis of the employee's obligation to keep secrets was originally associated with the rule of honesty or the obligation of loyalty in a broad sense, this issue has also found a separate place in the laws. It is arranged that the employee cannot use the information learned while working, especially production and business secrets, for his own benefit or disclose to others during the continuation of the service relationship. In addition to this regulation, the employee may also be obliged to keep secrets after the termination of the service relationship to the extent necessary to protect the valid interests of the employer. The concept that we call a business secret for an employer is extremely important, especially in our world where competition dominates today and is gradually accelerating. For this reason, we have tried to address the employee's compliance with the obligation to keep secrets, the scope of this obligation, and the consequences of non-competition obligations within the scope of our study. Within this framework, we have addressed concepts such as business secret, professional secret, customer secret, bank secret, obligation to keep secrets, non-competition debt and these issues have been examined from the labor law perspective.
