Abstract (EN)

The life of humanity is tied to money and its uses, and dealing with it in all its fields. This research aims to mention some banking services and transactions, their legal adaptations, and the opinions of scholars and legal councils regarding them. It also tries to address the ambiguities and issues that need clarification, specifically in Cihan Islamic Investment and Finance Bank in Erbil, in terms of its operations, types of services, and their legal adaptations. What prompted me to write about this topic is what we see daily of usurious transactions occurring in banks, and sometimes in Islamic banks under different names and titles aimed at attracting people's attention and legitimizing some transactions that are prohibited by Islamic law. Sometimes this is driven by political motives or supported by officials who have a significant share of usurious benefits in banks and commercial companies. There is great concern among citizens who deal with or wish to deal with banks to take loans or advances, or deposit money, or any transaction that raises suspicion of involving usury or any type of prohibitions defined by Islam, which threatens those who engage in them. Especially after I saw many people coming to the Fatwa Committee of the Union of Islamic Scholars in Erbil, asking about the loan granted by the government for building houses, and they see no way to take it because it involves a suspicion of usury. Some imams and preachers have issued fatwas declaring it permissible until a group of scholars affiliated with the Union of Scholars issued a fatwa on it, and I hoped to reach a final solution to the issue. The importance of this study is summarized in: presenting and rooting the elements of banking services in Islamic banks represented by Cihan Islamic Investment and Finance Bank, recognizing the characteristics of banking services, and encouraging Islamic banks to develop their activities and adhere to the Islamic financial system, as well as clarifying the components and pillars of banking services. The research assumes that the services provided by Cihan Islamic Investment and Finance Bank, such as murabaha, cards, letters, etc., comply with the provisions of Islamic law in their contractual forms and implementation mechanisms, which reflects on customer trust and increases the demand for dealing with it. There are previous studies on this topic, but they are not specialized in the services conducted at Cihan Islamic Investment and Finance Bank, thus distinguishing this research from the studies that preceded it. Through our study, we reached the most important results, including: 1. Cihan Bank is an Iraqi Islamic bank that has been operating since its establishment to serve citizens according to the principles and systems of Islamic law. 2. The legal fatwas of scholars and the Islamic legal council regarding many services provided by Islamic banks. Since the services and banking operations in Islamic banks have not yet reached the level expected by customers and clients, there has been ambiguity and a lack of trust in them, and people deal with them cautiously. Therefore, I recommend the following points: 1. Transparency and clarity, and getting closer to the poor and middle class in society, so they can benefit more, as they are the main component of society. 2. Introducing themselves to citizens more through their publications and media and service channels. 3. Sacrificing some of their profits to benefit the poor, especially in such harsh conditions, as the poor constitute the majority in society. 4. Avoiding usurious transactions and not trying to enrich themselves through them, while adhering to all the principles, systems, and legal rules. 5. Coordinating and cooperating with other banks and financial institutions, especially Islamic ones, to assist scholars and specialists in writing scientific research, especially related to the topic of halal and haram. 6. Opening courses and seminars for students and youth to enable them to listen to lectures directed by specialized scholars, and to spread Islamic knowledge and culture, especially regarding economic matters. 7. Competing to provide services from both quantitative and qualitative aspects, and not lagging behind the global financial and economic life, and improving their products and services based on the legal and financial analysis presented in our research. 8. We request the Central Bank of Iraq to support the adaptation of regulatory instructions to comply with legal principles. 9. We recommend that legal regulatory bodies develop internal supervision and auditing systems.
