VI ABSTRACT DOCTORATE THESIS STATE AND HIS FUNCTIONS IN HISTORY OF ISLAMIC LAW izzet SARGIN Supervisor : Prof. Dr. Beşir GÖZÜBENLİ 2001- PAGE :XV+245 Jury : Prof. Dr. Beşir GÖZÜBENLİ Term of Law and State are two facts which have made thought busy for centuries. The law, state and associations, functionally important, have different appearances in the historical process in theory and practice. Because the changing life forces people to develop new theories and applications. In addition to these, religion is an important element for arrangement. For this reason muslim jurists and practicers understantood and interpreted these concepts appropriately for their cultural environment, like all communities. In that case, in our time formation of state and law should be effected by cultural environment and accumulation. Texts (Nusûs), practices in history and the latest scholarly results must together determine the dimensions of this effect.
