Abstract (EN)
Modern humanitarian law theory based on individual-state contrast is a term used to protect human being against war and not to undergo them incompatible treatments with human dignity and human life. Although it is not defined as a theory in Islam, there is a framework that defines and implements how war and peace should be carried out, and this framework protects human rights. In this thesis, Islam's approach to law of armed conflicts will be discussed and the issue will be compared according to the international humanitarian law.This title will be dealt with in the opinion that human beings should know their right to life by coming into existance and learn the humanitarian law and the principles of war from the Islamic perspective in order to protect it, not as a defense against any situation or institution, far from the influence of political authorities. It will be tried to express the necessity of states and social policies that work for human rights to treat by taking into consideration these innate values, not political authorities.
