Abstract (EN)
Contemporary jurisprudential issues consistently arise, particularly in the field of medicine. The religious and legal examination of emerging matters holds great significance. In this context, one of today's critical topics pertains to vaccines. It is widely recognized that throughout history, vaccines have played a crucial role in the prevention or control of epidemic diseases that have led to numerous deaths and disabilities. The routine and experimental use of vaccines on individuals necessitates comprehensive research and evaluation within the domains of medicine and Islamic jurisprudence. This is because the assessment of vaccines within the framework of Islamic law significantly influences their acceptance or rejection in Islamic societies. This study is composed of an introduction and three main chapteres. In the first chapter, as a preparation for the main topics of the thesis, topics such as the definition and history of vaccines, the definition and history of vaccine refusal, vaccine production processes, the immune system, the effect of vaccination on autism in children, and the use of harmful chemicals will be discussed. The second chapter will examine the provisions of preventive treatment and vaccines from the perspective of Islamic law. In this context, the views, approaches, and evidence of Islamic scholars and jurisprudential councils who accept or reject vaccination will be evaluated. In the third section, primarily the jurisprudential dimensions and provisions of medical experiments will be evaluated, and the jurisprudential aspects of voluntary participation in vaccine research and testing vaccines on humans will be discussed. This study will be conducted using a library and qualitative research method, utilizing sources such as books, articles, official data from relevant organizations, and publicly available websites.
