Abstract (EN)

Since the earliest periods of human history, humanity has engaged in research and developed tools to ensure its survival, expand its living spaces, and achieve a more prosperous existence. As a result of this production process, numerous inventions have led to developments in today's fields such as artificial intelligence and bioengineering. During this period it was not limited to technological advancements. It also turned to various intellectual pursuits and laid the foundations of various ideologies. One of these ideological structures, transhumanism, aims to transform humanity into a post-human state, both physically and mentally, and leverages contemporary technological methods to achieve this aim.Locating itself as a continuation of the theory of evolution, transhumanism take advantage of genetic engineering as a tool to transcend the inherent limitations of human nature, aiming to elevate humanity to a virtually superhuman level. Some of these tools include genetic and medical methods such as stem cells, cloning, and CRIS-PR. Islamic law, on the other hand, addresses every aspect of human life, requiring individuals to consider the worldly and spiritual benefits and detriments of their actions and enacts laws accordingly. A situation that impacts humans within the framework of a materialist and hedonist ideology such as Transhumanism necessitates examination from the perspective of Islamic law.Accordingly, the primary objective of this thesis is to investigate genetic interventions on the fetus in the context of Transhumanism. In the first section of this study, the concept of the fetus will be defined through Qur'anic verses and Prophetic traditions, while examining the legal status of the fetus in Islam. The second section will introduce the concept of Transhumanism, analyzing its auxiliary methods in the process of genetic modification and the ethical dimensions associated with these practices. In the final section, the potential implications of applying genetic intervention techniques for Transhumanist purposes will be scrutinized from the perspective of Islamic jurisprudence.In doing so, this study aims to provide an Islamic legal perspective on a genetic modification system designed to alter the innate nature of humanity, thereby contributing to the relevant body of literature in this field.
