Abstract (EN)

What may be difficult to cany out by an individual, a group of professionals will be able to do easily through partnership. For a long time now the lawgivers have been trying to find a legal framework for this partnership. Islamic jurists have also stressed the importance of this matter. If we have a look at the classical sources of the Islamic law, we shall immediately appreciate this fact. The evolution of labor partnership through the time has been analyzed in detail in the present work. In the first sections the general information about the labor partnership has been given in order to point out its importance and to prove that this partnership is based on contracts. In spite of the existence of two kinds of partnership, the total and the limited, for the purpose of this work the latter has been chosen to examine the cases although the former has been approached in a general way. In the following sections the principles of labor partnership are introduced. Furthermore, once the basis accepted by all sides has been established, all of them should specify that they accept it and then carry out this agreement. In this way, all of them take advantage of and benefit from the partnership. The present work has been based on the Hanafi madhhab, however, the other madhhabs have also been taken into consideration in order to compare their judgement with that of the Hanafi madhhab.
