Liân and its rules in Islamic Law

Abstract (EN)

"Liân" is a divorce method of ending the marriage due to adultry by mutual act of swearing. It must be carried out before a court when a husband accuses his wife of adultery and does not accept that he is the father of the child who has not been born yet or who was born and cannot prove it with witnesses without himself. Our thesis called, "Liân and Its Rules in Islamic Law", consists of three chapters and a conclusion. In the introduction section the situations for dissolutions of marriage is explained briefly. In the first chapter, we present the definition of "liân", its jurisprudential meaning and the concepts of the word "liân". In the second chapter, we give information about legal basis, reasons and conditions of "liân". In the third chapter, the legal consequences of "lian" and the situations which abolish the legal consequences of "lian" are stated. Finally, in the conslusion, the outcomes of this study have been expressed. Key Words: Talaq, Liân, The Denial of Paternity.
