Abstract (EN)
The subject of our thesis is to investigate how and to what extent this kinship relationship that exists between the offender and the victim in Islamic law and the Turkish Penal Code No. 5237 affects the crime or punishment if they are relatives of each other. Our thesis consists of an introduction and two parts. In the introduction part, subjects such as the purpose and sources of our thesis are mentioned. In the first chapter, the concepts of crime and punishment in Islamic and Turkish Criminal Law and the elements of these concepts are given. In the second part, hadd crimes and retaliation crimes and punishments in Islamic law are discussed both in terms of their simple forms and in terms of the fact that the offender and the victim are relatives of each other. In the conclusion part, the findings were evaluated and the study was concluded.
