Land acquistion of İstanbul Northern Marmara Motorway (İstanbul 3rd Bosporus Bridge)

One of the main problems of construction Yavuz Sultan Selim Bridge (3rd İstanbul Bosphorus Bridge) and the Northern Marmara Highway (NMM) which provides access to this bridge is to receive ownership of private property land and real-estates. Gain from private property land and real-estates to public property in the project area of NMM which provides access to Yavuz Sultan Selim Bridge have been carried out by using expropration method. Basis of the research problem is the expensiveness of expropriation technique and falling back on ownership right. With this study, it is tried to show the results of this situation especially in huge projects. In the introduction part of the thesis, we made a summary of the literature that were read and used in our study, and the purpose and hypotheses of our thesis are reported. In the second part, after explaning the methods used to acquire the ownership of the real estates for public investments, the methods are explained preferred by the General Directorate of Highways (GDH) in the project NMM III. Stage (Odayeri - Paşaköy section). In the third part, informations about NMM Project is given and each expropriation zone located in III.Stage, that enclose both collars of İstanbul, has been analyzed separately. With the appraisal reports prepared by GDH appraisal commisions, also procedure has been done according to 8th and 10th articles of the expropriation law, number and area of the real-estates located in project impact region are shown in this part. In the conclusion part, all data obtained from this study are evaluated as a whole and agreement and disagreement rates are listed. Expropriation and construction costs, market values of the real-estates calculated according to real-estate tax of 2009, 2012, 2014 and 2017 are interpreted comparatively. Afterwards, suggestions for reducing the cost of acquisition of property were presented.
