Abstract (EN)

As a result of the work relationship, there exists the employee's duty to perform work for the employer; and the employer's duty to pay wage to the employee. The wage to be received has great importance both individually and socially for the employee who works for the survival of himself and his family. Since the field study has not been conducted on this particular subject, the implementation dimension has been explained by the help of the views on the doctrine, the Supreme Court decisions and my observations of the work life in accordance with my occupation. Although the Labor Law contains imperative provisions for the protection of employee's wage; respective legal regulations are neither clear nor protective enough. It is observed that the legal remedies applied by the employees in case of the employer to default on wage payment duty are not easy and effective. In accordance with being a social state principal; it occours that the employee's wage, unpaid by the employer, should be secured by the state in order to protect labor more. Key Words: Time of Remuneration, Default, Refutation of Non-payment, Right to Refuse Work.
