Abstract (EN)
Workplace violence often arises from the employer's or third parties' failure to fulfill their legal obligations, leading to legal liability. The Turkish Code of Obligations, the Labour Law, and the Occupational Health and Safety Law impose a duty on employers to protect employees against all forms of violence. On the international level, instruments such as ILO Convention No. 190 and the Universal Declaration of Human Rights provide a global framework for this obligation. Judicial decisions by the Turkish Court of Cassation and the administrative sanctions introduced by Law No. 6701 come into play when this duty is breached. This study emphasizes not only the relevant legal regulations but also the importance of practical enforcement and institutional awareness. Furthermore, it examines examples from comparative law and offers policy recommendations based on international practices.
