Özet (EN)

The crime of involuntary manslaughter resulting from gynecological surgical operations is a concept signifying a distinctive meaning for surgeons, patients, and jurists respectively. In the wake of death resulting from gynecological surgical operations, patients' relatives go through a period of questioning regarding if death was truly inevitable, and as to whether or not the situation arose from a medical error. Herein, elucidating the concept of complication doesn't tend to be easy. The ultimate level of attainment a surgeon can achieve regarding patients' welfare is managing such complications correctly if they were to arise. On the other hand, the occurrence of death following a surgical operation is a crime requiring official investigation according to the Turkish Criminal Law. Judgement regarding the typical crime is a period necessitating expert witness investigation, and verdict is mostly an obiter dictum resulting from this technical investigation. Death following surgical operation is one of the most difficult situations to rectify concerning the establishment of justice, it is an issue requiring a multidisciplinary approach to resolve, and oftentimes satisfying each party's sense of justice proves itself to be difficult. In our thesis, the crime of involuntary manslaughter resulting from gynecological surgical operations has been reviewed with regard to medical standards and law in force.
