Özet (EN)

In this study there are three chapters in which resaearching the land survey court, a court with special trial, with the features of the law procedure practised in it. In the first chapter, considering of the Turkish Land Survey Act from the point of view of Turkish law and comparative law, purpose of the Turkish Land Survey Act and its? fetures and how the limitation and determination constituting technical part of the Land Survey is realized, is researched. The purpose of discussing this chapter in this work is to give information about the private law side of the Land Survey making easy to undrstand the procedural law subjects which will be researced in the other chapters.The study is about our country?s land survey practices based on the Law Of Land Survey numbered 3402, also, in the process of trial, the supreme court decisions are investigated. In this study, investigating Supreme Court decisions, the subjects in the doctrine are thoroghly examined with different opinions The principles which the Law Of Land Survey bases on are evaluated and thus. When we consider the large amount of land which aren?t included in the Land Survey, the legal foundations related to Land Survey practices which are on trial are displayed/revealed.Keywords1.
