An investigation for renew of the cadastral maps

The cadastre processes with an exception to the forest cadastre, have been performed by the Cadastre Directorships under TKGM and the changes after the cadastre process have been update by these Cadastre Directorships, too. The graphical cadastre sheets that are used today have been using their practicability against the continuously developing technology because of the failures derived from limitation, scale, drawing and calculations or seen to be defective or it can not show the borders of the ground in accordance with the truth.Because of the future of the cadastre of our country, the cadastre should be kept up to date and perpetuated by availing from the technological developments of our age. In order to update the cadastre sheets that out of date and make them appropriate for the requirements of the conditions of our age and technology, ?the Regulation Related to the Procedures and Principles for Re-Arrangement of the Cadastre Maps and Making the Required Corrections on the Land Register? that has been published in the Official Gazette with 29/11/2006 date and 26361 number and come in to force with the ?Act Related to the Renewal of the Land Register and Cadastre Sheets? with 22.a article of the act with 2859 Number and according to the act with 3402 number and it is aimed to update these sheets in order them to meet the requirements of the technology of our age and to be appropriate and practicable.In this study, the studies started to be performed under the Act with number 2859 and continued under the 22.a article of the Cadastre Act with 3402 at the Yeşilli Stream of Yeşilli District of Mardin Province of the Diyarbakir Regional Directorship of the DSİ General Directorship have been chosen as a sample application because during the improvement studies in order to measure the fixed assets of the Yeşilli Stream and it has been detected by the drawing that the effective ground and the sheets are not fit and as a result of this the sheets with (1-44) numbers belong to the Yeşilli District Merkez Neighborhood does not show the floor borders truly. It has been detected that the measurements performed at the fixed borders of the floor cadastre sheets of Yeşilli District Merkez Neighborhood with (1-44) numbers does not fit in with the data provided from the digitization of the sheets and tachometrical scale table of the calculated values. These studies could not be continued within the Renewal Act with 2859 number because of the limitation errors appeared in the limitation plans. These studies are being continued according to the 22.a article of the Cadastre Act with 3402 number. During the studies performed according to the requirements of the Renewal Act with 2859 number and 3402/22.a application regulations it has been only possible to correct the technical errors and it has not been possible to perform the technical and legal corrections of the cadastre and land registers.The Renewal Act with 2859 Number and the application regulation of 3402/22.a are only related to technical corrections, these can not meet all the correction related requirements because they do not include the legal corrections and updates. In order to solve the experienced legal problems, it is required the Cadastre Act with 3402 Number to be arranged in order to enable the second cadastre and to perform the legal arrangements in order to enable the evaluation of the data in the information system.Because it has been planned to complete the cadastre studies of our country in 2008, it has been considered to renew most of the cadastral sheets produced before the Act with 3402 came in to force in accordance with the technology of our age by putting out an open tender to the private sector. Therefore, it has understood that the issue to renew the ?cadastral sheets? in detail that we will experience in the following years for the efficiency, speed, accuracy and sensitivity of the studies.Keywords: Cadastre, The Renewal of Cadastral Maps, Renewal Law, 3402/22.a Applications
