Abstract (EN)

In the first part of the thesis, namely Stopping The Position?s RisePenalty, discipline decisions of State Officials Law, numbered 657, havebeen generally considered. Application range of Criminal Law principles atDisciplinary regulations and effects of criminal court judgements on diciplineinquiries have been examined.In the second part, differences of the stopping positions rise penaltyfrom the other penalties, explained in the first port and significantcharacteristics of that penalty have been expressed. Inquiry stage andauthorities of discipline committee have been especially stated.After that, objection and application for judgement to the disciplinepenalties have been presented. Rights of objection against warning andcondemnation penalties, and application to judgement way for otherpunishments have been mentioned. At the judgement part, officials havebeen mostly considered while explaining the issue.In the thesis, issues have been generally argued at the light ofdecisions of courts. In order to be more explanatory and to be a sample,these decisions have been used without any alteration.Besides, in the result of the cancellation of penalties, court decisionsbeing obligatory to be applied due to rule of absolute validity of judgementdecisions has been briefly mentioned.
