Abstract (EN)

The woman has an important place in the construction and structuring of society. Because a woman is the most basic part of society and the family institution. The family is the basis of society. The existence of safe and peaceful family structures is important for the construction of healthy societies. Because the family is the first social circle of people and the first institution that prepares people for society. People first learn about the norms such as morality and values that keep society afloat in the family institution. For this reason, the protection of women and the family has become a necessity for the survival of humanity and society. One of the most important dangers to women and the family institution is violence. Violence can be divided into justified and unjustified. Violence that a person applies to protect himself or others' life, property, rape, body integrity, or that states apply to protect the legitimate legal order; is considered justified violence. Unjust violence, on the other hand, is one of the biggest dangers for humanity that has been discussed all over the world and has still not been resolved. Many studies have been carried out and continue to be carried out to solve the problem of unjust violence in Turkey. These studies have emerged on the axis of women and the family in general. In this area, the Council of Europe Convention on the Prevention and Fight against Violence Against Women and Domestic Violence (Istanbul Convention) and the Law Numbered 6284 on the Protection of the Family and the Prevention of Violence Against Women play an important role. In this study, the causes of violence, the relationship between family and woman violence and the Istanbul Convention, the text of international law regulated in this regard, and the Law No. 6284, the national legal text prepared in its light, were examined. In this context, it is aimed that the thesis study will contribute to the violence-themed studies that will take place in Turkey, especially family and women.
