Abstract (EN)

Discipline can be defined as an order that people working in the state and other public legal entities are obliged to comply with and face various sanctions if they do not comply. In our country, when we look at the basic legal regulations regarding the disciplinary law of public personnel, we encounter here, especially the Law No. 657 on Civil Servants, the Law on Higher Education No. 2547, the Turkish Armed Forces Discipline Law No. 6413, and the Decree Law No. 7068 on General Law Enforcement Disciplinary Provisions. There are other regulations not mentioned. It is an important issue in which status these regulations will be applied to the personnel working in the institutions. The National Defense University (MSU) is one of the important institutions of our country, which was established in 2016 under the Ministry of National Defense and has the unique and special duty and responsibility of training military personnel for our army, to which the war schools and other military institutions are connected. MSU employs public personnel of different statuses in order to fulfill its duties in the best way possible. These statuses are; Officers, non-commissioned officers and other military personnel are civil servants and academic personnel due to their academic activities. In our study, the method of disciplinary investigation of the civilian academic staff working in MSU has been tried to be explained. In this context, in the first part of our study, the concept of discipline was examined, the principles of disciplinary law were revealed, and concepts similar to disciplinary investigation were tried to be explained. In the second part, the status of the personnel working in MSU has been tried to be explained, since MSU employs personnel with different status. In the third part, the disciplinary investigation procedure according to the Law No. 2547 has been tried to be examined in detail. In the fourth chapter, the disciplinary investigation procedure according to the Law No. 657 has been tried to be explained by not including the issues explained in the third chapter and which are also valid for the disciplinary investigation of civil servants.
