The obligation of the public official to report the goods (Declaration of goods numbered 3628 covered by the law against bribery and corruption)

In our country, due to the role of the state in the economy, public officials take a direct role in the fulfillment of public service and may be subject to special benefits, unlike a normal citizen. For these reasons, some legal arrangements have been needed since the first years of the Republic so that public services can be effectively and efficiently presented. It is the situation in which the public officer is practicing in the interests of fulfilling the requirements of his / her duty. Some of the citizens give unfair advantage to the public officials in order to make the public services that they benefit more quickly. In order to prevent bribery and corruption and to become a state of law, many important works have been done and still continue to be done. In our country, those who are in public service and those who fulfill certain professions that are of legal significance in the absence of public personnel; bribery, corruption and similar crimes, and preventing the acquisition of unfair goods, 3628 of the most comprehensive law prepared to prevent misdemeanors, bribery and corruption. In fact, the most important thing to be done in order to prevent corruption in public administration is to provide a cultural infrastructure based on the principles of justice, equality and accountability. Moreover, the moral equipment of public officials must be extremely high in order to prevent corruption incidents. Our work has been prepared with the aim of investigating, analyzing and evaluating the regulations contained in the Law on the Prevention of Bribery and Corruption Law No. 3628, together with other national and international legislation. In this study, the legislation related to the declaration of property by public officials, many books, thesis, magazine, article, report, web pages were used. In the first part of our study; the concept of public servant, the legal basis of the declaration of property, the scope for the purpose and persons, and the goods to which the declaration of property shall be given. In the second part of our study; the subjects of the declaration of goods, the confidentiality and exceptions of the declaration of the goods, the method of giving the declaration of goods and the concept of the gift have been dealt with and the issues that have been encountered and hesitated in practice have been tried to be explained by high court decisions. In the third part of our study; the responsibilities of the supervisors in giving the declaration of property, the crimes of the declaration of property under the Supreme Court decisions and the punishments and the proceedings of the investigation and prosecution are included. In the result part of our study; a general evaluation of the law no. 3628 on the obligation of public officials to submit declarations of property has been made, and proposals on the problems arising from the applicability of the law and the implementation and the solutions of these problems have been given.
