Abstract (EN)

Right of meetings and demonstrations is a fundamental right and freedom which has both an individual and a collective side, both organizing and joining an organization, both creating public opinion and having expression direction to come together in order to share ideas and serve to create a common mind. The State has the mission of both recognizing the rights of meetings and demonstrations of individuals and taking the necessary measures to ensure the exercise of this right in accordance with their objectives. However, the right to meetings and demonstrations has been regarded as one of the biggest threats to the authorities of the government in the historical process, and this right has been one of the rights and freedoms that are the most interfered by both legal regulations and administrative practices. This thesis studies firstly the concepts of meetings and demonstrations, historical development and limits of the right of meetings and demonstrations and its relations with similar freedom and concepts. Crimes of Organizing Unlawful Meetings and Demonstrations and Resistance made in Law no. 2911 are studied, the other crimes in Law no. 2911 are studied about only main lines. The repealed Law no. 171 and the corresponding provisions of Law no. 2911 have been compared when appropriate. This study does not only benefit from Supreme Court Practices but also from European Court of Human Rights decisions and when appropriate, from the Constitutional Court decisions.
