Withdrawal of driver's license under the Highway Trafic Law

Transportation, which has become an important part of human life, is generally carried out by the motorway, airline, seaway, and railway. Of these, however, motorways are the most used and most preferred mode of transportation. Traffic refers to the state and behaviour of pedestrians, vehicles and animals on highways for purposes of travel. With the widespread use of transportation and the invention of modern vehicles, the concept of "traffic accident" has emerged, and it has become necessary to regulate the state and behavior of drivers and pedestrians on the road. In this context, many legal and administrative regulations have been made. Upon the emergence of the phenomenon of "traffic accidents", when the causes of these accidents were investigated, it was determined that driving under the influence of alcohol, drugs or stimulants is one of the important causes of the occurrence of accidents, for driving under the influence of alcohol, drugs and stimulants is one of the biggest factors that reduce the ability to drive safely in traffic. In this respect, as in all countries of the world, driving under the influence of alcohol and drugs is prohibited in our country. Violating this prohibition has legal, criminal and administrative consequences. The most important result in administrative sense is the sanction of revocation of the driver's license. When previous studies on this subject are examined, it is seen that the administrative sanction of the revocation of the driver's license has not widely been discussed. In this respect, this study deals with the administrative sanction of the revocation of the driver's license. In order to narrow the scope of the issue and focus on the most common practice, the sanction for the withdrawal of the driver's license has been examined in terms of the misdemeanor of driving under the influence of alcohol and drugs. The study includes the theory of misdemeanor and administrative sanctions. Because the issue in question is the revocation of the driver's license as an administrative sanction in response to the act of driving under the influence of alcohol or drugs, which is of a misdemeanor nature. The study also deals with the misdemeanor of driving under the influence of alcohol, drugs or stimulants, as well as the misdemeanor of not allowing the use of technical devices for the purpose of detecting alcohol or drugs. Another issue included in the study is the investigation of judicial application procedures against the administrative sanction of revocation of the driver's license.
