Abstract (EN)
Introduction and Purpose: The word disability is defined as "handicap" in the dictionary, and it is the state of lack or complete loss of the ability to perform an activity within the limits of what is considered normal for a person by any restriction or in some way.In this study; it is aimed to shed light on the provision of the examination and proportional standard by determiningthe injuries and sequelae of 200 randomly selected casesdue to musculoskeletal injurywhose disability report was drawn upin Gaziantep University Forensic Medicine Department, according to the "Capacity to Work and Vocational Permanent Disability Rates Detection Operations Regulations" before 31.12.2020 and re-evaluate in the internationally accepted American Medical Association Permanent Disability Assessment Manual and to make suggestions for new regulations that are needed internationally. Materials and Methods: Gender, age at the date of the incident, type of the incident, time between the date of the incident and the evaluation, referral center, type of injury, anatomical structure of the wound, history of operation, presence of nerve injury,proportional equivalents of injuries and sequelae according to the D and E charts of the "Capacity to Work and Vocational Permanent Disability Rates Detection Operations Regulations",whether discretion was used in determining the ratewere retrospectively scanned and evaluated for 200 randomly selected cases with musculoskeletal injuries, upon the request of the judicial authorities, with a disability report before 31.12.2020. Proportional recalculations were made using the American Medical Association Permanent Disability Assessment Manual, 5th Edition. The data were evaluated in the SPSS program. Results: Of the 200 cases evaluated within the scope of the study, 70.5% were men and 29.5% were women, the highest reason for admission was traffic accidents with 96.5%, the highest injury rate was 49.5% for isolated lower extremity injuries, 66% of the cases whose disability rate was calculated were applied assessment. There is a statistically significant difference between the rates of loss of function obtained according to the D and E charts of "Capacity to Work and Vocational Permanent Disability Rates Detection Operations Regulations"and the AMA guideline. Conclusion: In the light of the findings, the "Capacity to Work and Vocational Permanent Disability Rates Detection Operations Regulations"chart contains deficiencies compared to the international AMA guideline, which is in use in many countries. We believe that it will be the best approach to create a guide in accordance with objective and up-to-date norms for our country, in which the disability rate can be determined according to the profession and age of the person, but which does not allow questioning and assessment while doing this; and can also be used alone in cases such as traffic accidents, work accidents, occupational diseases, terrorism, disability from duty and war.
