Investigation of the need for real estate valuation report as a basis for land share determination in the establishment of condominium ownership

In the processes related to the determination of land share in the establishment of condominium ownership, there are significant deficiencies in the selection of criteria, weighting of criteria, data accuracy and the relationship of these data with the real estate valuation process. In this study, a literature review was conducted to identify the relevant issues, semi-structured interviews were carried out with field experts, and the developed interview form was applied to a sample group selected from field experts. This study is a case study conducted in Midyat district of Mardin province, involving a detailed analysis of cadastral data, title deed records, and general construction projects (architectural plans) pertaining to 852 primary real estate properties in the study area and the findings were visualized through parcel-based thematic maps. The research findings indicate that there is no standardized practice framework for determining land share, that condominium ownership files are prepared in varying formats, and that similar issues have persisted from past to present. In this context, it is necessary to conduct scientific studies that take into account the land share valuation criteria and weights in different regions, and to prepare a valuation report that includes the valuation date, criteria selection and weights. The establishment of a standardized legal and technical infrastructure across the country will contribute to the prevention of deficiencies in current practices and legal disputes by ensuring the adoption of a holistic and systematic approach in land share determination processes.
