Determination and analysis of Kemalpaşazâde's criticisms to Sadruşşerîa (In the context of El-Îzâh Ve Şerhu'l-Vikaye

Islam is a life-order system which governs social life. The rules for social life as a result of Islam's universal principles manifest its juridical aspect. The corpus of Islamic Law, enlarged as a result of the activities of the jurists, also necessitated the concise literature. One of the works written in this context is the work of Burhânüşşerîa named Vikâye. The first and most famous commentary of the Vikaye which is very popular in the field of Islamic Law, is Sadruşşerîa 's Şerhu'l-vikâye and both works have been the main teaching material for madrasahs for centuries. Both works, which were given importance by Islamic jurists and were therefore subject to many commentaries, poems and works, was only criticised by Şeyhülislam Kemalpaşazâde. Kemalpaşazâde edited the mistakes of Vikâye in the text of el-Îzâh fî şerhi'l-ıslâh, with the commentary section Kemalpaşazâde edited the mistakes of Şerhu'l-vikâye and Kemalpaşazâde criticised the authors of both works. Kemalpaşazâde has been criticized since its period due to this criticism. In this study, appropriateness of the sect in Kemalpaşazâde 's criticism on Sadruşşerîa was analyzed by determining the criticism. In the first part of the study, which is composed of three sections, Kemalpaşazâde and Sadruşşerîa, in the second section, Şerhu'l-vikâye and el-Îzâh was introduced and in the last section criticism which is the main subject of the thesis was determined and the suitability of the sect was determined. As a result, 26 criticisms were identified and 6 of them were found to be valuable in terms of Islamic Law, others were found to be literal discussions.
