Abstract (EN)
This study has been issued as the post gradute thesis in İstanbul University's Institute Of Social Sciences. The subject of our thesis is aboutrental 's evacuation by the renter dueto a necessity which is stated on TBK's (Turkish Obligations Code) 350/1.1st art. Which are considered as the termination causes that derives from the renter, with in the scope of "Termination of The Agreements For Dwellings and Work places With Roof" pursuant toTurkish Obligations Code. With in the first part of our study, rental agreement, aspects of the rental agreement, states of termination of the agreements for dwelling sand work places with roof have been examined. With in the second part of our study, rental 's evacuation dueto a necessity, the concept of necessity in this scope, the concepts of dwelling and work l place necessity have been studied; traits of the necessity which causes the rental's evacuation have been examined together with the decrees of the high Judicial bodies and the opinions with in the doctrin. As the third part of our study, the law suit of rental 's evacuation dueto a necessity and it's results have been examined in the light of the decrees of the high Judicial bodies and the opinions within the doctrin.
