The crime of making or selling medicines in a way that will endanger persons' life and health in Turkish Criminal Law (TCK 187)

Throughout history, people have resorted to using medications to protect their health or seek treatment. However, while medications can protect people's health, they can also have negative consequences due to known or potential side effects. In some cases, the medications people use can even cause death. Therefore, because medications directly affect human health, the experimental stages required by modern medical science for a drug must be successfully completed and the drug must be approved by the relevant authorities. Therefore, in the production and sale of drugs, great care must be taken during these stages, and any resulting side effects must be monitored. Sometimes, even research is insufficient to identify drug side effects. Even after a drug is released to the market and used by a significant number of people, it is possible that it may not produce positive results but instead cause serious illnesses. In this context, the production and sale of drugs is of great importance, and the liability of numerous individuals, from the pharmaceutical manufacturer to the doctor and pharmacist who prescribes the drug, can be a concern. Within this framework, the legislator criminalized the act of manufacturing or selling drugs in a manner that endangers the health and life of individuals in Article 187 of the Turkish Penal Code. This study examines the concepts of drug and drug manufacturer, the material subject of this crime, the material and moral elements of the crime, the protected legal value, the perpetrator and victim of this crime, the factors affecting the crime, the specific manifestations of the crime, and its relationship to other crimes.
