Abstract (EN)

Civil status refers to the status that arises with the person's acquisition of personality and ends with his death. Civil status changes refers to the changes of a temporary or permanent nature that occur as a result of the person's own acts and actions or other people's active or passive acts and actions. The term of civil status has gained importance in the historical process with the usage of civil status data as a kind of surveillance instrument. These data were used to determine whether individuals fulfill their obligations to the state and to keep individuals under the control. However, with the emergence of the social state understanding in time, the usage of the civil status term has expanded and changed. As a result of the social state understanding, civil status has also become functional in responding to the demands of individuals to the state. Thus, the civil status has turned into a multifunctional concept that serves both the public interest and the interests of individuals. In Turkish Law is also benefit from civil status changes and in this context from civil status registration in the realization of the social security right. Civil status changes in terms of social security law, while give to the individuals the opportunity to claim their social rights, on the other hand, give to the state the opportunity to refuse or to fulfill these demands to the extent of the responsibility it assumes. In addition, it gives to the state the duty and authority to maintain the functioning of the system by keeping it under control. Accordingly, civil status changes make possible the social insurance system, social assistance and social services to be privatized according to the civil status of the insurants or beneficiaries.
