Abstract (EN)
Cryptocurrencies produced with blockchain technology make it easier to commit many crimes due to their financial value and their ability to 'anonymise the user'. In our study, after discussing whether cryptocurrencies are money in economic and legal terms, they were classified as transparent cryptocurrencies and non-transparent cryptocurrencies according to their supply systems. Then, according to this distinction, the methods of using cryptocurrencies in committing the crime of fraud regulated in the Turkish Penal Code are explained and the amendment made to the Capital Markets Law on 26.06.2024, the crime of 'Crypto Asset Service Provider Embezzlement' was also mentioned and its difference from the crime of fraud was evaluated. Finally, investigation methods to prove the crime within the scope of the Code of Criminal Procedure are explained.
