Abstract (EN)
The subject matter hereof titled the ?adoption of minor children? has beenassessed and arranged under Articles 305 to 312 of the Turkish Civil Code. Theadoption of a minor child depends on three common conditions. The first one is thatthe minor child should have been cared, maintained and educated for at least oneyear by the adopter, and the second one is that such an adoption is to be in thebenefit of the adoptee, and the third one is that the adoption would not unjustifiablyjeopardize the rights and benefits of any other children. These conditions have beenset forth to prevent any possible adoption that would likely harm the children. Theprinciple of protecting the children?s rights and benefits is a fundamental rule of thefamily law, and hence should be applied as a fundamental rule for adoption of theminor children. The main objective of this study is to elaborate and enlighten theadoption that serves caring and educating the children, who are the guarantee of thecontinuity of a society, in an healthy environment of physical, mental and socialdevelopment.
